(TNS) As Sen. Lindsey Graham (R-S.C.) noted correctly on Thursday following the partisan Dem-led impeachment of President Donald Trump for no reason other than because they could, Nancy Pelosi may be the Speaker of the House but she’s not the Senate Majority Leader because, obviously, she can’t be both.
This was in response to Pelosi stating that despite the House formally returning two articles of impeachment against President Trump, she’s not going to ‘transmit’ them to the Senate nor name any House managers to present the case to the Senate until she’s sure there will be a “fair trial.”
It’s laughable to hear Pelosi or any Democrat talk about “fairness” after the shaft job they gave the president in the House with secret ‘impeachment’ hearings in the basement of the Capitol Building, using third- and fourth-hand witnesses instead of fact witnesses to claim ‘criminal activities,’ and breaking every rule possible to rush impeachment to a vote.
Graham was incredulous.
“Just think for a moment, you pass articles of impeachment in the House, you refuse to send them into the Senate until the Senate constructs a trial of your liking as Speaker of the House,” Graham said.
“We have separations of power for a reason. You can’t be Speaker of the House and Majority Leader of the Senate at the same time.”
Right. But besides that, constitutional attorney and expert Mark Levin noted further that Pelosi’s threat to withhold the impeachment articles as a tool of political leverage is blatantly unconstitutional.
And what’s more, he has a solution: Senate Majority Leader Mitch McConnell (R-Ky.) should tell Pelosi and her Garbage Party to pound sand.
“Nancy Pelosi was apparently advised by leftwing Harvard law professor Lawrence Tribe to delay sending the impeachment to the Senate. So she’s unilaterally sitting on the impeachment. This is another brazen unconstitutional act,” Levin wrote Thursday morning on his Facebook page.
“Here’s what Mitch McConnell and the Senate Republicans must do in response: The Senate has the sole power under the Constitution to adjudicate an impeachment,” he continued.
“Therefore, Pelosi is attempting to obstruct the Senate’s power to act on its constitutional authority. McConnell should immediately put an end to this and declare the impeachment null and void as the speaker has failed to complete the impeachment process by timely sending it to the Senate for adjudication,” Levin, former chief of staff for the Reagan Justice Department, wrote.
“McConnell has no less authority to unilaterally make such a decision than Pelosi does to withhold the administrative notification of an impeachment to the Senate either indefinitely or with conditions. Her effort to cripple the presidency and blackmail the Senate must be defeated.”
